1. Acceptance of Terms

By accessing or using beverlyindex.com, the NOUS platform, or any Beverly Index services, you agree to these Terms of Service. If you do not agree, do not use our services.

2. Service Description

Beverly Index LLC provides cognitive assessment technology through the NOUS Cognitive Intelligence Platform, including the REMIEL Engine analysis system, DreamWeaver visualization, Memoria Sonata audio synthesis, Empyrean 3D topology, and related clinical and forensic tools.

Important: Beverly Index technology is designed to augment, not replace, professional clinical judgment. Assessment results should be interpreted by qualified, CNAP-certified practitioners. Public demo experiences are for educational and exploratory purposes only and do not constitute clinical assessment or diagnosis.

3. User Accounts

Practitioner Accounts: Access to the NOUS platform requires valid CNAP certification or authorized organizational credentials. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

CNAP Student Accounts: Enrollment in the CNAP certification program creates a student account governed by the CNAP Program Agreement provided at enrollment.

4. Intellectual Property

All technology, methodology, algorithms, scoring systems, visualizations, and content on this website and platform are the proprietary intellectual property of Beverly Index LLC, protected by 35+ patent applications, 23 trademark registrations, and applicable copyright and trade secret law.

You may not reverse engineer, decompile, or attempt to derive the source code or methodology of any Beverly Index technology. Unauthorized reproduction, distribution, or commercial use of any content or output is strictly prohibited.

5. Acceptable Use

You agree not to:

• Use the platform for purposes other than legitimate clinical assessment, research, or authorized forensic analysis
• Attempt to extract, scrape, or automate access to analysis outputs
• Share assessment results outside the clinical or authorized context in which they were generated
• Use demo features to process narratives for clinical, legal, or forensic purposes
• Misrepresent Beverly Index results as a substitute for licensed clinical diagnosis

6. HIPAA and Clinical Data

Clinical use of the NOUS platform involves protected health information (PHI). All PHI handling is governed by our HIPAA compliance policies and applicable Business Associate Agreements. See our HIPAA Compliance page for full details.

7. Limitation of Liability

Beverly Index LLC provides its technology "as is" for use by qualified professionals. We are not liable for clinical decisions made based on platform output, which remains the responsibility of the treating practitioner. Assessment results are one input among many that a qualified professional should consider.

8. Termination

We may suspend or terminate access to our services at our discretion, including for violation of these terms, misuse of the platform, or expiration of CNAP certification. Upon termination, your right to access the platform ceases immediately.

9. Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
